TERMS OF
SERVICE

These Terms govern your access to and use of the Bordio website, gaming platform, games, accounts, multiplayer features, virtual items, subscriptions, digital purchases and related services. By using Bordio, you agree to them.

Welcome to Bordio. Please read these Terms carefully before using the platform. If you do not agree to them, you should not use Bordio. Bordio is an independent web-browser gaming platform operated from London, United Kingdom, and is currently in beta.

01. About Bordio

Bordio is an independent web-browser gaming platform operated from London, United Kingdom.

Bordio is currently operated by Louis Lombardi, a sole trader trading as Bordio, supported by a small independent development team.

References in these Terms to "Bordio", "we", "us" or "our" mean the person operating Bordio and, where appropriate, members of the Bordio team acting on their behalf.

If Bordio is transferred to or operated by a limited company in the future, we will update these Terms and provide the relevant company information.

02. Bordio is in Beta

2.1 Beta and Early Access

Bordio is currently a beta platform. The platform itself, user accounts, multiplayer features, paid memberships and many of the games available through Bordio may be in beta, Early Access, testing or active development.

This means things may occasionally go wrong. You may experience bugs, crashes, incomplete functionality, balancing problems, graphical issues, connection problems, multiplayer issues or other unexpected behaviour.

Features may also be added, changed, redesigned, reset or removed as development continues.

2.2 Games in development

Some games available through Bordio are unfinished or experimental. A game’s mechanics, maps, characters, progression, items, scoring systems, statistics, achievements, save data or other features may change significantly before the game reaches a full release.

Participation in an Early Access or beta game does not guarantee that the game will eventually receive a full commercial release.

2.3 Data and progress during beta

We take reasonable steps to protect account information, game progress and saved data.

However, while Bordio remains in beta, we cannot guarantee that game saves, statistics, rankings, achievements, progression, inventories or other game-specific data will never need to be reset, migrated or changed. Where reasonably possible, we will try to avoid unnecessary loss of user progress.

2.4 Platform availability

We do not guarantee that Bordio or any particular game will always be available. We may temporarily suspend services for maintenance, security work, upgrades, bug fixes or other operational reasons.

Games or features may also be retired where continuing to operate them is no longer reasonably practical. Where a change materially affects paid digital content or services, we will respect any rights or remedies you have under applicable consumer law.

03. Playing Without an Account

You do not need a Bordio account to enjoy many of our games. Guests may play games that we make publicly available without creating an account.

However, some Bordio functionality requires an account. Without an account, you may not have access to features including persistent game statistics, saved progress, friends, private multiplayer lobbies, in-game chat, favourites, account customisation, virtual items, skins, themes and other account-based functionality.

Some individual games or features may also require an account for technical, safety, multiplayer or age-verification reasons. We may change which features require an account as Bordio develops.

04. Bordio Accounts

4.1 Account eligibility

Bordio accounts are currently available only to people aged 18 or over. If you are under 18, you must not create a Bordio account or pretend to be 18 in order to access account-only functionality.

People under 18 may still be able to play games that Bordio makes available without an account, provided that the particular game is appropriate for their age and is not subject to an age restriction.

4.2 Age-restricted games

Some games, content or functionality may be intended only for adults. Where a game or feature is restricted to users aged 18 or over, we may require the user to sign in and complete an age check before access is granted.

We may use age-assurance or identity-verification measures where required by applicable law or where we reasonably consider them necessary to protect users. The verification method used may depend on the country from which you access Bordio and the legal requirements applying there.

Failure to complete a required age check may result in access to certain games, features or services being restricted.

4.3 Accurate information

You must provide accurate information when creating and maintaining your account. You must not create an account using another person’s identity, impersonate another person or intentionally provide false information for the purpose of bypassing an age restriction, ban, security measure or other platform restriction.

4.4 Personal accounts

Bordio accounts are intended for personal use. Unless we expressly allow otherwise, you must not sell, rent, transfer or commercially trade your Bordio account.

05. Account Security

We take account security seriously. Bordio uses technical and organisational security measures designed to protect user accounts and platform data. Where passwords are stored by Bordio, they are stored using secure password-hashing techniques rather than being stored as readable plain-text passwords.

No internet service can guarantee absolute security, and you are also responsible for taking reasonable steps to keep your account secure. You should use a strong and unique password and must not intentionally give another person access to your login credentials. You should never provide your Bordio password to another player.

If you believe your account has been compromised, accessed without permission or otherwise affected by a security issue, contact us as soon as possible at bordiogames@gmail.com

We may temporarily restrict an account where we reasonably believe doing so is necessary to protect the account, other users or Bordio.

07. Payments, Cancellation and Refunds

Prices will be displayed before you make a purchase. Payments may be handled by third-party payment providers, and the payment provider used may be displayed during checkout.

Bordio does not intend to store complete payment-card information where this is instead securely handled by an authorised payment provider.

Digital purchases

Because many Bordio purchases provide digital content or digital services that can become available immediately, your cancellation rights may differ depending on what you buy. Where applicable law provides you with a cooling-off or cancellation period, that right will apply.

Where you specifically request immediate access to digital content or services during a statutory cancellation period, you may be asked to acknowledge that this can affect your right to cancel or the amount that may be refundable.

Faulty digital content

Nothing in these Terms removes rights you have under applicable consumer law. Where paid digital content is faulty, not as described or does not meet legal requirements, you may be entitled to a repair, replacement, price reduction, refund or another remedy depending on the circumstances.

Refund requests

If you believe you have been charged incorrectly or believe you are legally entitled to a refund, contact bordiogames@gmail.com. We will consider refund requests fairly and in accordance with applicable law. Nothing in these Terms limits your statutory consumer rights.

08. Bord Coins

Bordio plans to introduce a virtual currency known as Bord Coins or a similar in-platform currency. Bord Coins are a digital entitlement for use within Bordio only. They are not real-world currency.

Bord Coins may, depending on the game or feature, be earned by playing games, received as part of a subscription or promotion, or acquired through a permitted one-off purchase.

Bord Coins have no cash value

  • Cannot be exchanged with Bordio for cash.
  • Cannot be withdrawn into a bank account.
  • Cannot be redeemed for real-world money.
  • Do not represent money held on your behalf.
  • Do not represent a bank account, investment or financial product.
  • Cannot be sold, traded or exchanged outside Bordio.

Unless Bordio expressly introduces a feature allowing transfers between users, Bord Coins may not be transferred between accounts. You must not operate, promote or participate in an unauthorised marketplace for buying or selling Bord Coins.

Using Bord Coins

Bord Coins may be used for eligible digital products or features within Bordio. These may include in-game items, profile customisation, cosmetics, themes, skins, upgrades or other digital features.

The number of Coins required for particular items or features may change as games and the Bordio economy develop. Changes will normally apply prospectively and will not turn Bord Coins into real-world money.

Removal of Coins

Bordio will not arbitrarily confiscate purchased Bord Coins. However, Coins may be removed or access to them may be lost where this results from a valid account closure, refund, reversed or fraudulent transaction, serious breach of these Terms, correction of an obvious technical error, exploitation of a bug or other circumstances permitted by applicable law.

09. Virtual Items, Skins, Themes and Digital Content

Bordio may allow users to acquire digital items including skins, themes, cosmetics, avatars, profile upgrades, in-game items and other virtual content.

Acquiring a virtual item gives you a limited personal right to use that item within Bordio. It does not give you ownership of the underlying artwork, software, game assets, characters, trademarks or intellectual property.

  • Virtual items are for personal use within Bordio.
  • They cannot be exchanged for cash.
  • They cannot be sold outside Bordio.
  • They cannot be transferred unless Bordio specifically provides a transfer feature.
  • They may only be used with games or features that support them.

Games evolve over time, particularly during beta. We may occasionally need to modify the appearance, properties, balancing, functionality or availability of a virtual item. Where a significant change affects something you paid for, we will consider any consumer rights that apply.

10. Community Behaviour and Acceptable Use

Bordio is designed to be a fun place to play games with other people. You must treat other users reasonably and must not use Bordio to harm, threaten, exploit or deliberately disrupt other people.

You must not use Bordio to engage in or facilitate:

  • Harassment and abuse — targeted harassment, bullying, stalking, intimidation, repeated unwanted contact or deliberately abusive behaviour.
  • Threats and violence — credible threats of violence, encouraging violence, threatening terrorist activity, or organising or encouraging criminal violence.
  • Hate and discrimination — racist, homophobic, sexist or other hateful abuse targeting people based on protected or personal characteristics.
  • Sexual abuse or exploitation — sexual harassment, grooming, sexual exploitation, child sexual abuse material or attempts to sexualise, exploit or endanger children.
  • Doxxing and privacy violations — publishing or threatening to publish another person’s private information without permission.
  • Fraud and scams — phishing, scams, payment fraud, fraudulent chargebacks, account theft and attempts to deceive other users for financial or personal gain.
  • Impersonation — deliberately impersonating another player, a member of the Bordio team or another person in a deceptive or harmful manner.
  • Cheating and automation — unauthorised bots, scripts, cheats, automation, modified clients or other tools intended to provide an unfair advantage.
  • Exploiting bugs — accidentally discovering a bug will not get you banned, but deliberately exploiting one to gain items, Coins, rankings or progression may result in action against your account.
  • Hacking and security attacks — attempting to gain unauthorised access to another account, Bordio systems, databases, servers, APIs or infrastructure, interfering with availability or security, introducing malware, performing denial-of-service attacks or bypassing security controls.
  • Spam and disruption — flooding chats, disrupting multiplayer sessions or using Bordio primarily to advertise, spam or repeatedly interfere with other players.
  • Unauthorised trading — selling Bordio accounts, Bord Coins, virtual items or access to Bordio features unless expressly permitted.
  • Ban evasion — creating or obtaining another account in order to bypass a suspension or permanent ban.
  • Illegal activity — using Bordio to commit, encourage or facilitate criminal activity.

We encourage users who discover security vulnerabilities or serious exploits to report them responsibly instead of abusing them.

These examples are not intended to provide loopholes for harmful behaviour that happens to use a slightly different method. We may take reasonable action against behaviour that clearly threatens the safety, security or proper operation of Bordio even where the exact behaviour is not specifically named above.

11. Reports, Moderation and Enforcement

Users may report behaviour, accounts, messages or other content that they reasonably believe breaks these Terms or applicable law. Where reporting tools are available within Bordio, we encourage users to use them. Serious concerns may also be reported to bordiogames@gmail.com

We may investigate reports and other suspected violations. Depending on the seriousness, frequency and circumstances of the behaviour, action may include:

  • Taking no action where a report is not substantiated.
  • Issuing a warning.
  • Removing content.
  • Restricting chat or multiplayer functionality.
  • Removing improperly obtained virtual items or Coins.
  • Resetting unfairly obtained statistics or progression.
  • Temporarily suspending an account.
  • Permanently banning an account.
  • Reporting suspected criminal activity to an appropriate authority where required or appropriate.

We may act immediately where we reasonably believe there is a serious threat to another user, Bordio, our systems or the public. For less serious matters, we may use warnings or temporary restrictions before considering a permanent ban.

We are not required to disclose confidential security information, information that could endanger another person or information that could compromise an investigation.

12. Permanent Bans and Paid Content

Permanent bans are intended for serious misconduct, repeated breaches or circumstances where allowing an account to continue operating would create an unacceptable risk to Bordio or its users.

Where an account is permanently terminated because of a serious or repeated breach of these Terms, the user may lose access to that account and anything attached to it. This may include:

  • Virtual items, skins and themes.
  • Profile customisation.
  • Bord Coins.
  • Saved progression.
  • Account benefits and multiplayer access.
  • Other account-specific digital content.

A permanently banned user is not automatically entitled to compensation simply because they can no longer access benefits attached to the banned account. Refunds will not normally be provided where access has been lost as a direct result of the user’s serious misuse of Bordio.

However, nothing in this section removes any refund, cancellation or other consumer rights that the law requires us to provide. Where appropriate, users may contact bordiogames@gmail.com if they believe a moderation or banning decision was made incorrectly.

13. Online Safety and Illegal Content

Bordio is committed to providing a safe gaming environment and to complying with applicable online-safety laws, including requirements arising under the UK Online Safety Act 2023 where those requirements apply to Bordio.

Because Bordio may provide multiplayer lobbies, player-to-player communication, profiles and other interactive functionality, we take user safety and illegal content seriously. We will take proportionate measures intended to reduce the risk of Bordio being used for illegal activity or the distribution of illegal content.

This includes maintaining reporting and moderation processes and taking appropriate action when we become aware of potentially illegal content or behaviour. Bordio does not permit content or behaviour involving matters such as terrorism, child sexual exploitation or abuse, credible threats, illegal hate activity, stalking, serious harassment, fraud or other criminal conduct.

Where we become aware of illegal content, we may remove or restrict it as soon as reasonably practicable. Where necessary, we may also restrict accounts, preserve relevant information, investigate reports or cooperate with law-enforcement agencies or regulatory authorities in accordance with applicable law.

We may implement additional safety features as Bordio develops, including user reporting tools, blocking features, moderation systems, safety controls and age-assurance measures. We also review the risks associated with new social and multiplayer functionality as the platform develops.

Users should report potentially illegal or seriously harmful activity using Bordio’s reporting functionality where available or by contacting bordiogames@gmail.com. A report does not guarantee a particular moderation outcome. We will assess reports based on the information available, these Terms and our legal obligations.

14. Intellectual Property

Bordio and the games, software and content made available through it contain intellectual property belonging to Bordio, members of the Bordio development team and/or our licensors. This may include:

  • Source code, software and game code.
  • Game mechanics and content.
  • Graphics, artwork, characters and animations.
  • Sounds and music.
  • Text, logos and branding.
  • Interfaces and level designs.
  • Virtual items and website content.

Except where applicable law expressly allows otherwise, you may not copy, reproduce, redistribute, sell, commercially exploit or create unauthorised versions of Bordio content without permission from the relevant rights holder.

Your use of Bordio gives you a limited, revocable, non-exclusive and non-transferable right to access and use the platform and its games for personal entertainment in accordance with these Terms. It does not transfer ownership of Bordio intellectual property to you.

User-generated content

Where Bordio allows you to create or submit content such as messages, profile information, usernames, avatars or other material, you remain responsible for that content. You must have the right to submit anything you provide to Bordio.

You grant Bordio a non-exclusive licence to host, process, reproduce and display that content only as reasonably necessary to operate, secure, moderate and provide Bordio. This does not give Bordio ownership of your original content.

We may remove user-generated content where it breaches these Terms, applicable law or our safety requirements.

15. Updates, Changes and Discontinuation

Games and online services change over time. Bordio may update the platform and its games in order to add features, improve gameplay, fix bugs, improve security, rebalance games, comply with legal obligations or otherwise develop the service.

We may change or remove free features without guaranteeing that those features will remain permanently available. Where possible, we will try to avoid unnecessarily disrupting users.

We may also discontinue a game or service where maintaining it is no longer reasonably practical. This might happen because of low usage, technical limitations, licensing issues, security concerns, legal requirements or changes to Bordio’s development plans.

If discontinuing or materially changing something affects paid content or an ongoing subscription, we will take into account our obligations under applicable consumer law and provide notice where required.

16. Our Responsibility to You

Bordio is being developed by a small independent team and some of the platform remains in beta. We therefore cannot promise that Bordio will always operate without bugs, downtime or interruptions. However, nothing in these Terms excludes or limits liability where doing so would be unlawful.

If you are using Bordio as a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill where the law requires us to do so. We are not responsible for losses that could not reasonably have been foreseen when you agreed to these Terms.

Bordio is provided primarily for personal entertainment. We are not responsible for business losses including loss of profits, revenue, business opportunities or commercial data resulting from use of Bordio by someone for business purposes.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot legally be limited or excluded. Nothing in these Terms affects your statutory consumer rights.

17. Closing Your Account

You can request deletion of your Bordio account through your account settings. The account deletion option can be found within Settings → Danger Zone.

Deleting an account may permanently remove access to information and digital content associated with the account. This may include friends, favourites, save states, statistics, progression, private lobbies, virtual items, profile customisation and Bord Coins.

The account deletion process may explain additional steps that are required where you have an active subscription or payment arrangement. Before deleting your account, you should review any warnings shown within the Danger Zone carefully.

Account deletion does not automatically create a right to a refund for previously used digital services, virtual items or Bord Coins, although any statutory refund or cancellation rights you have continue to apply.

Certain information may need to be retained after account deletion where reasonably necessary for legal, security, fraud-prevention, dispute-resolution or regulatory purposes. More information about how personal data is handled will be provided in our Privacy Policy.

18. Changes to These Terms

Bordio is evolving, so these Terms may occasionally need to change. We may update them because of:

  • New Bordio features and new games.
  • Changes to payments or subscriptions.
  • The introduction of Bord Coins.
  • Safety or security improvements.
  • Changes in applicable law or regulatory requirements.
  • Changes to how Bordio operates.

For minor changes that do not materially affect your rights, we may update these Terms by publishing a revised version. Where a change materially affects your rights, an ongoing paid service or the way you are expected to use Bordio, we will provide reasonable notice where required.

Urgent changes may take effect more quickly where necessary for legal, regulatory or security reasons. The latest version of these Terms will include the date on which they were last updated. Where reasonably required, we may ask account holders to actively accept materially updated Terms.

19. Complaints and Contacting Bordio

We want problems to be reported rather than ignored. You can contact us about account problems, payments, refunds, security concerns, moderation decisions, suspected cheating, inappropriate behaviour, illegal content, technical problems or general questions about Bordio.

When reporting another user, please provide enough information for us to understand what happened. Where possible, this may include the relevant username, game, lobby, approximate time and a description of the behaviour. Do not put yourself at additional risk in order to gather evidence.

We will aim to consider complaints fairly. Submitting a complaint does not guarantee that Bordio will agree with the requested outcome. Where an account has been suspended or banned, we may review a decision if the user provides relevant information showing that an error may have occurred.

20. Privacy

Bordio does not sell users’ personal information.

We may use trusted service providers where reasonably necessary to operate Bordio, provide infrastructure, process payments, deliver communications, secure accounts, prevent fraud or comply with legal obligations.

How information is collected, used, retained and disclosed is explained separately in our Privacy Policy. Our Privacy Policy forms an important part of how Bordio operates but does not replace these Terms.

21. Other Policies

Additional rules may apply to specific parts of Bordio. These may include our:

  • Privacy Policy, including its section on cookies and local storage.
  • Community Guidelines / Acceptable Use Policy.

Those documents should be read alongside these Terms where applicable. If there is a direct conflict between these Terms and a Community Guideline relating to account enforcement, these Terms will take priority unless we expressly state otherwise.

22. Transfer of Bordio to a Company

Bordio is currently operated as a sole-trader business. We intend that Bordio may later be incorporated and operated through a UK limited company.

If this happens, the rights and obligations relating to the operation of Bordio may be transferred to that company where legally permitted. We will update these Terms to identify the new legal entity and will provide notice where required.

A change in Bordio’s business structure will not remove any statutory consumer rights you already have.

23. Severability

If a court or other competent authority determines that part of these Terms is unlawful or unenforceable, the remaining parts of these Terms will continue to apply.

Where reasonably possible, the affected provision should be interpreted or adjusted only to the extent necessary to make it lawful and enforceable.

24. No Waiver

If Bordio does not immediately enforce a provision of these Terms, this does not mean that we have permanently given up the right to enforce it.

25. Governing Law

Bordio is operated from London, United Kingdom. These Terms and any dispute relating to them are governed by the laws of England and Wales.

If you are a consumer living elsewhere, you may also benefit from mandatory consumer protections provided by the laws of the country in which you live. Nothing in these Terms removes rights that applicable law does not allow you to waive.

Subject to those rights, disputes relating to Bordio may be dealt with by the courts of England and Wales.

26. Final Terms

These Terms represent the agreement between you and Bordio concerning your use of the Bordio platform, together with any additional policies or purchase terms that expressly apply.
